ARIA Music Teacher Award Public Voting Terms And Conditions

Submitting a vote is deemed acceptance of these terms and conditions.

1. Who Can Vote?

Voting is open to residents within Australia. If you are aged under 18 years at the time of voting, you must obtain your parent or legal guardian’s consent before submitting a vote.

2. When Can You Vote?

  • Public voting commences on 19 September 2024 at 6:00am (AEST) and concludes on 13 November 2024 at 11:59m (AEDT) (Voting Period).

You must cast your vote within the designated Voting Period. ARIA may vary the Voting Period at its discretion and will publish any changes to the Voting Period on: https://www.aria.com.au/vote

3. How Can You Vote?

Votes for the ARIA Music Teacher Award (the “Award”) can be cast via the Award voting page which is accessible on the ARIA website at https://www.aria.com.au/vote , and if available, a voting iframe which may be embedded on the websites of other ARIA partners.

4. How Many Times Can You Vote?

Votes are limited to one (1) vote per IP address per day (i.e. the time period from 00:00 to 23:59 is considered as one day).

You are able to change the vote that you have cast during the day, but if you do so it will override your previous vote and your last vote for the day will be eligible to be counted. 

5. How Much Does it Cost to Vote?

ARIA does not charge any fees for submitting a vote. However there may be costs associated with your internet service provider or mobile/other device service or data charges. ARIA is not responsible for any costs incurred by you when casting a vote. You should check with your service provider for details of such fees before submitting a vote.  

6. What Votes are Invalid?

The following votes are invalid:

  • votes cast outside of the Voting Period;
  • votes cast from outside of Australia;
  • votes generated by a script, computer programs, macro, programmed, robotic or other automated processes or methods;
  • votes that are incomplete, corrupted, false, lost, late, misdirected or deceptive;
  • votes that threaten, harass or abuse other persons;
  • votes that are otherwise not in compliance with these Terms & Conditions; and/or
  • votes that are reasonably suspected to have been fraudulently made to unfairly alter or influence the voting results.

ARIA and its authorised contractors, reserve the right to verify the validity of all votes and to disqualify any person that ARIA determines has tampered with the voting process, engaged in any unlawful or other improper misconduct calculated to jeopardise the proper conduct of the voting process, has submitted a vote that is not in accordance with these Terms & Conditions or who has, in the opinion of ARIA engaged in conduct or generally damaging to the goodwill, integrity or reputation of the ARIA Awards, ARIA or the Award itself. Any votes submitted by such person in the aforementioned manner may be deemed invalid by ARIA in its sole discretion. ARIA reserves the right in its sole discretion to disqualify any individual or disregard votes cast by such individual who ARIA has reason to believe has breached any of these Terms and Conditions. Where necessary, a contingency plan may be actioned at ARIA’s discretion. ARIA’s decision in relation to all matters affecting the voting is final and no correspondence will be entered into.

7. General Voting Requirements

  • You may need to have java script and/or cookies enabled to be able to submit a vote via the online voting page/iframe.
  • Once you are on the voting page on the Award page/iframe, you will be required to follow the links and prompts to vote. If you successfully submit your vote, you will receive a message on your screen to confirm that your vote has been successful. If you do not receive a confirmation message, you will need to try again.
  • Votes are deemed made at the time each vote is received by ARIA in its database and not at the time sent by the voter. ARIA accepts no responsibility for any late, lost or misdirected votes due to technical disruptions, network congestion or for any other reason. This also includes, and is not limited to errors made by a voter as a result of time differences between time zones in Australia.
  • Access to the Award voting page/iframe may be restricted for certain tablet, mobile or other portable devices. It is your responsibility to check the functionality of the voting application on your device prior to voting.
  • No prizes will be awarded for those participating in public voting for the 2024 ARIA Music Teacher.

8. How will the ARIA award winner be determined?

 ARIA will collate and calculate the total number of valid votes submitted during the Voting Period for each of the nominees in the Award category.

The winner of the Award will be determined by means of a public online vote and an industry online vote. The members of the industry voting group will comprise of professionals in the music industry, media and the field of music education. It will also comprise of personnel from ARIA partners/sponsors and other persons who are connected or have a professional interest in music education and/or the Award. Members of the industry voting group will only be permitted to cast one vote in total.

The final voting tally for the Award will be calculated on the basis of both the results of the general public voting and the results of the industry online voting. The votes from the public and the industry will each account for a 50% share of the vote. Public votes and industry votes will each determine an overall ranking for each Award nominee.  Votes from the public and the industry will be weighted to ensure that the votes from each of the two sources have equal impact on the final result. In the event of a tie in any of the categories, the winner will be selected by ARIA representatives.

ARIA’s determination in relation to the final voting results is final and no correspondence will be entered into. ARIA reserves the right to keep the voting tally confidential. No results other than what is required for the purpose of the announcement of the 2024 Award winner will be released to the public.

9. Privacy

ARIA may collect personal information about you for the purposes of conducting this public voting process, to enable you to vote, to ensure compliance with these Terms & Conditions and as a security feature to minimise voter fraud. This may include your:

  • name;
  • contact information (including email address, residential address and phone number);
  • social media handle; and
  • device’s IP address.

This information may be collected to verify your compliance with these Terms & Conditions, the origin of your vote and to determine the number of votes submitted per device and IP address.

ARIA is bound by the Australian Privacy Principles (“APPs”) in the Privacy Act 1988 (Cth) and by casting a vote, each voter is taken to consent to ARIA’s privacy policy.  11. General Information

If for any reason this voting process is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of ARIA, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the voting process, then ARIA reserves the right in its sole discretion to disqualify any person who tampers with the voting process, take any action that may be available and/or to cancel, terminate, modify or suspend the voting process. Additionally, if for any reason, this voting process is interrupted in any way, or for any other reason that ARIA determines in its sole discretion to be reasonably necessary, ARIA reserves the right to select the winner of the Award, taking into consideration the number of votes received by each nominee up until the time of the interruption or cancellation of the voting process.

ARIA (and its associated agencies, members and sponsors), will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the voting process except for any liability which cannot be excluded by law. ARIA is not responsible for any incorrect or inaccurate information either caused by the voter or for any of the equipment or programming associated with or utilised in this voting process; or for any technical error, or any combination thereof that may occur in the course of the administration of the voting process including any omission, interruption, deletion, defect, delay in operation or transmission, communications or network failure, theft or destruction or unauthorised access to or alteration of votes.

You indemnify and hold ARIA (and its associated agencies, members and sponsors) harmless from any claim or demand, including reasonable legal fees, made by a third party due to or arising out of the violation of these Terms & Conditions by you.

ARIA reserves the right to amend these Terms & Conditions at any time. These Terms & Conditions are governed by the laws of the State of New South Wales.
