VOTING TERMS AND CONDITIONS

Submitting a vote is deemed acceptance of these terms and conditions.

1. WHO CAN VOTE?

Voting is open to residents in Australia (except in the category of Most Popular International Artist where eligible votes will be accepted via X/Twitter from all countries throughout the world). If you are aged under 18 years at the time of voting, you must obtain your parent or legal guardian’s consent before submitting a vote.

2. WHEN CAN YOU VOTE?

You must cast your vote within the designated Voting Period. ARIA may vary the designated Voting Period for any of the ARIA Award categories at its discretion. ARIA will publish any changes to any Voting Period on https://www.aria.com.au/vote

●     You may cast a vote via the designated voting webpage available on the ARIA Awards website at: https://www.aria.com.au/vote (ARIA Voting Page). You do not have to register with ARIA to cast a vote via the ARIA Voting Page.

●     Once you are on the ARIA Voting Page, you must make your selections, then click the “vote” button to submit your vote.

General Voting Conditions

4. HOW MANY TIMES CAN YOU VOTE?

Voting via the ARIA Website

Votes submitted via the ARIA Voting Page in the applicable categories are limited to one (1) vote per ARIA Awards category per IP address per day (i.e. the time period from 00:00 to 23:59) during the relevant Voting Period.

In relation to votes submitted via the ARIA Voting Page, you are able to change the vote/s that you have cast during the day, but if you do so it will override your previous vote and your last vote for the day will be considered. 

Voting via X/Twitter

Votes submitted in the ARIA Award category of Most Popular International Artist are unlimited during the specified Voting Period. There is no daily limit to the number of times you may submit a vote via X/Twitter for this ARIA Awards category.

5. HOW MUCH DOES IT COST TO VOTE?

ARIA and X/Twitter do not charge any fees for submitting a vote. However, there may be costs associated with your internet service provider or mobile/other device service or data charges. You should check with your service provider for details of such fees before submitting a vote. 

6. WHAT VOTES ARE INVALID?

ARIA and its authorised contractors, reserve the right to verify the validity of all votes and to disqualify any person that ARIA determines has tampered with the voting process, engaged in any unlawful or other improper misconduct calculated to jeopardise the proper conduct of the voting process, has submitted a vote that is not in accordance with these Terms & Conditions or who has, in the opinion of ARIA, engaged in conduct or generally damaging to the goodwill, integrity or reputation of the ARIA Awards or ARIA. Any votes submitted by such person in the aforementioned manner may be deemed invalid by ARIA in its sole discretion. ARIA reserves the right in its sole discretion to disqualify any individual who ARIA has reason to believe has breached any of these Terms and Conditions. Where necessary, a contingency plan may be actioned at ARIA’s discretion. ARIA’s decision in relation to all matters affecting the voting is final and no correspondence will be entered into.

7. HOW WILL THE ARIA AWARD WINNER BE DETERMINED?

ARIA will receive, collate and calculate the total number of valid votes submitted during the relevant Voting Period for each of the nominees in each of the ARIA Awards categories listed in clause 3 above. The nominee with the most valid votes (calculated following the conclusion of the Voting Period), as determined by ARIA, will be declared the winner of the ARIA Award in that category.

ARIA’s determination is final and no correspondence will be entered into. ARIA reserves the right to keep the voting tally confidential. No results other than what is required for the purpose of the announcement of the winners of the 2023 ARIA Awards will be released to the public.

8. PRIVACY

ARIA may collect personal information about you for the purposes of conducting this public voting process, to enable you to vote, to ensure compliance with these Terms & Conditions and as a security feature to minimise voter fraud. Types of personal information collected by ARIA may include your:

ARIA is bound by the Australian Privacy Principles (“APPs”) in the Privacy Act 1988 (Cth) and by casting a vote, each voter is taken to consent to ARIA’s privacy policy.  10. GENERAL INFORMATION

If for any reason this voting process is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of ARIA, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the voting process, then ARIA reserves the right in its sole discretion to disqualify any person who tampers with the voting process, take any action that may be available and/or to cancel, terminate, modify or suspend the voting process. Additionally, if for any reason, this voting process is interrupted in any way, or for any other reason that ARIA determines in its sole discretion to be reasonably necessary, ARIA reserves the right to select the winner of the particular public voted ARIA Award category, taking into consideration the number of eligible votes received by each nominee up until the time of the interruption or cancelation of the voting process.

Please note that any Tweets that you cast as a vote in the category of Most Popular International Artist can be seen by the public and may be retweeted or subject to replies by the public. ARIA and X/Twitter Inc have no liability to you in respect of this.

ARIA (and its associated agencies, members and sponsors), Google, X/Twitter Inc, Stan Entertainment Pty Ltd (Stan) and Nine Network Pty Limited (Nine) will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the voting process except for any liability which cannot be excluded by law. ARIA (and its associated agencies, members and sponsors), Google, X/Twitter Inc, Stan and Nine are not responsible for any incorrect or inaccurate information either caused by the voter or for any of the equipment or programming associated with or utilised in this voting process, any public comments, retweets or statements made online or elsewhere by persons in relation to your Tweet/vote; or for any technical error, or any combination thereof that may occur in the course of the administration of the voting process including any omission, interruption, deletion, defect, delay in operation or transmission, communications or network failure, theft or destruction or unauthorised access to or alteration of votes.

You indemnify and hold ARIA (and its associated agencies, members and sponsors), Google, X/Twitter, Stan and Nine harmless from any claim or demand, including reasonable legal fees, made by a third party due to or arising out of the violation of these Terms & Conditions by you.

ARIA reserves the right to amend these Terms & Conditions at any time. These Terms & Conditions are governed by the laws of the State of New South Wales.
